Wecht Trial Blog: Jury Goes Home Early

Channel 4 Action News reporter Bob Mayo is covering the trial of Dr. Cyril Wecht at the federal courthouse in downtown Pittsburgh. He will be posting blogs as often as possible from court. These are the raw notes that were sent on his mobile device.


Wecht Trial Day 34 - April 7, 2008: Jury Watch Day 10

8:30 AM The door to Judge Arthur Schwab's courtroom is again locked, so reporters are using the attorney conference rooms to await word of any question or verdict from the jury. The court clerk would not respond to the question of whether the jury has resumed deliberations as scheduled.

8:41 AM Attorneys for the prosecution and the defense say they believe the jury has resumed deliberations; they've not been informed otherwise. A check of the PACER online court filing system does not show any ruling on the defense motion for a mistrial that was filed on Friday. Judge Schwab did, however, refuse the prosecution's formal motion asking him to instruct the jury on how to return a partial verdict.

11:56 AM. The jurors were just led out of their deliberations room and down the hall to the elevator. The judge's clerk told us only that we should check the electronic court filing system.

12:05 PM. The jury concluded deliberations at 11:55 AM, pursuant to the jurors' request. They'll be back to resume at 8 AM tomorrow. Schwab today issued a ruling denying the defense request that he declare a mistrial. That ruling revealed that the jurors began today's deliberations at 8 AM. That means they've now deliberated for 52 hours over the course of 10 working days.
