Call 4 Action: Pothole Problems

Call 4 Action reporter Meghan Jones says a pothole this week on William Penn Highway in Churchill was caused by gas crews digging up the street for routine service work.

"We temporarily covered the hole when we completed the job," Dominion Peoples spokeswoman Denise Hughes said. "With the unusual wet weather and warm temperatures, sometimes these holes will open up and cause a pothole."

The company has repaired the hole, but drivers who suffered damages can file a claim by calling (800) 764-0111.

"Upon an investigation into the incident, Dominion will consider making restitution," Hughes said.

Most potholes are repaired by a government agency, not a private company.

Under Pennsylvania law, the government can only be liable for physical injuries that result from a pothole if there has been written notice and the injury was reasonably foreseeable. Vehicle damage is not included.

If you hit a pothole for which the state or a county or municipality is responsible, you'll pay for the damages out of your own pocket.
