A Fayette County girl testified about her mother's alleged plot to get her pregnant by a boyfriend because the mother has been unable to have children of her own.

The mother -- who is not being identified to protect the child -- waived her preliminary hearing Tuesday, saying she did not want to force her daughter to testify against her. But the 13-year-old still had to take the witness stand against the other suspect, Duane Calloway.

Crying and shaking, with blotches on her face, the girl held her stomach as if she was in pain and proceeded to tell her story to Senior District Judge Michael Rubish.

She claimed that her mother set her up by twice lacing her drinks with sleeping pills. Both times, she claimed to have awakened and found Calloway touching her.

Once, when she was left alone with Calloway at his Uniontown home, the girl said she had to fight the man off and run for help.

"Her story was the same throughout the investigation and while she was testifying today in court," Uniontown police Detective Donald Gmitter said.

The mother begged her daughter to carry a child for her, and when the girl refused, the mother allegedly planned to drug her or get her drunk and let Calloway try to get the girl pregnant, the child said.

Defense attorney Jeffery Proden said Calloway has had "a steady job, a steady residence, for a long period of time. These charges are a complete surprise to him, and he is going to defend them."

"We want him home because he did not do this," said Calloway's fiancee, Ashleigh Lee. "This man is a hard-working man. He waked up at 5 a.m. to go to work, does not get home until 7:30, 8 o'clock at night."

Calloway, of Uniontown, is charged with attempted rape. Rubish sent his case to trial after the preliminary hearing. A trial date has not been set.

The mother's charges include endangering the welfare of children. Her trial date has also not been scheduled yet.
