Lawsuit Against Classmate Dismissed In New Castle Girl's Oxycodone Death

High School Student Died After Taking Painkiller

A judge has dismissed a wrongful death suit against a teenager accused of delivering drugs to another student from New Castle Senior High School who overdosed.

Lawrence County Judge Craig Cox says 16-year-old Erica Million was culpable in her own death because she bought and ingested the oxycodone.

Million, of West Pittsburgh, died five days after taking an unknown amount of the painkiller and falling unconscious at school in February 2007.

A 17-year-old student was found delinquent in juvenile court for providing the pills to Million and was placed on probation until his 18th birthday. He was also expelled from school.

The teenage boy denies selling the drugs and says he was framed by other students who lied about how Million got the oxycodone.
