2008 PITTSBURGH -- Lawyers for the Upper St. Clair School District are asking a federal judge to dismiss a lawsuit claiming the district failed to protect a student from being raped by a boy accused of other attacks.According to a report by WTAE Channel 4's news exchange partners at the Pittsburgh Tribune-Review, the school district claims only one teacher -- who was an independent contractor -- knew about the alleged previous incidents. An attorney for a teenage girl and her family sued the school district in June, claiming the girl was raped in a school stairwell on Feb. 4.Five girls were attacked by the boy, and at least three of them reported it to school officials before the February case, the lawsuit claims. The suspect is charged as a juvenile and is not being identified because of his age.
