Pa. Supreme Court To Hear Oakmont Gas Well Zoning Appeal

The Pennsylvania Supreme Court has agreed to hear an appeal by the borough of Oakmont, which wants to use zoning rules to limit the drilling of gas wells.

The Commonwealth Court has overturned the borough's decision to deny a permit to Huntley and Huntley Inc. of Monroeville, which wanted to drill a well on a residential property.

The borough said its zoning rules don't permit such activity in a residential area. But the Commonwealth Court says the state's Oil and Gas Act of 1984 doesn't allow municipalities to prevent drilling for gas wells and voided the borough's ruling.

Although the court has agreed to hear the appeal, it is not clear when that will occur.
