Murder Case Against Father's Teen Girl Sent Down To Juvy Court

A teenage girl accused of shooting her father to death in Elizabeth Township is no longer being charged as an adult, and her case will be sent to juvenile court instead.

The decision to transfer the homicide case against Matthew Booth's 13-year-old daughter was made Friday morning, one day after an Allegheny County judge ordered the suspect moved from the county jail to Western Psychiatric Institute. She could be there anywhere from three to 20 days.

WTAE Channel 4 Action News is not identifying the suspect by name because there have been allegations of abuse connected to her case.

Police said Booth, 34, was found dead of a shotgun wound to the face at his Pitt Street home on Monday morning.

Earlier this week, a neighbor told WTAE Channel 4 Action News that the girl claimed Booth had been sexually abusing her.

Prosecutors did not fight requests by the girl's attorney to move the child out of jail and try her as a juvenile.

On Friday, District Attorney Stephen Zappala said that the suspected killer is as much a victim as Booth.

"She's going to stay in the juvenile system," Zappala said.

A psychiatrist testified Thursday that the girl was angry and verbally abusive, and needs treatment and therapy for a mood disorder.

"She's as much the victim as she is the perpetrator, possibly," said Zappala. "I say possibly, because she stands present charged with criminal homicide. The question that's been on my mind is it more she took somebody's life or did she try to save her own life?"

Investigators said they found deplorable conditions when they arrived at the home. A humane officer from Animal Friends was called to remove several pets.

"What was described in terms of how she was living -- it's just incredible," Zappala said.

"Her father had literally forced her to the point where she thought she was in danger of death or serious bodily injury if she did not act," said defense attorney Patrick Nightengale. "She acted in the only way that this scared 13-year-old girl could act."

The girl's mother, Michelle Fazek, who was separated from Booth, told WTAE Channel 4 that she had made several unsuccessful requests for action from the county Office of Children, Youth and Families.

A CYF representative said the case is under review.
