A former Wilkinsburg police chief will stand trial on theft charges.

But a district justice Friday threw out a conspiracy charge filed against Gerald Brewer and all charges filed against former borough detective Diana Maddox.

Brewer, 49, and Maddox, 36, were arrested Nov. 6 and charged with stealing more than $20,000 from a police department evidence safe since 1999.

The district attorney's office began investigating after two Wilkinsburg police officers discovered money seized as drug evidence missing from the safe in Brewer's office in May 2000. Brewer resigned in December 2000.

According to the indictment, Brewer and Maddox often played video poker and went to a West Virginia racetrack twice a month. The couple's financial records also showed "a mountain of debt" totaling $58,585, authorities said.
