Company Sues Wal-Mart, Developer Over Route 65 Landslide Cleanup

A huge landslide closed Route 65 in Kilbuck Township for more than a week in September and now, one of the companies hired to clean up the mess is saying they have yet to paid for their services.

R.J. Corman Derailment Services, of Kentucky, said it worked around the clock for six days cleaning up dirt and debris piled up on the highway.

Much of the debris was then moved to the top of the hillside

The bill came to $143,000, but Corman said it never got paid.

Last week Corman filed a lawsuit against Wal-Mart, which was planning a store at the site.

Also named in the suit are Kilbuck Properties and other developers who hired Corman.

A spokesman for Wal-Mart said the company had not yet seen the lawsuit, so they could not comment.

No one from Kilbuck Properties returned phone calls.

In January, the state Department of Environmental Protection fined Kilbuck Properties $470,000 for failing to come up with a plan to stabilize the hillside.
